What Is an Executive Session?

During our Monday night, April 13th council meeting, when the forensic audit update was brought forward, it was recommended by our City Attorney that Council move into an executive session.

An executive session is when the Mayor and City Council step out of a public meeting and into a closed, private discussion—but only for very specific legal reasons.

Under the Georgia Open Meetings Act, executive sessions are allowed for:

  • Legal matters and consultation with the city attorney

  • Pending or potential lawsuits

  • Real estate negotiations

  • Personnel matters

 Here’s the key:

No final decisions are made behind closed doors. Any vote must happen publicly.

Why Does It Exist?

Executive session is not about secrecy—it’s about protection.

It allows your city leaders to:

  • Receive honest legal guidance

  • Protect taxpayer dollars

  • Handle sensitive matters appropriately

But let me be clear…

 It is not meant to be used to hide information from you.

How This Connects to the Forensic Audit

Many of you have been asking about the forensic audit—and rightfully so.

A forensic audit is serious. It looks deep into financial activity and can uncover:

  • Mismanagement

  • Irregularities

  • Potential legal concerns

Because of that, certain discussions may occur in executive session, especially when:

Legal Risk Is Involved

If findings could lead to legal action, Council may need to consult privately with the City Attorney.

Attorney-Client Privilege Applies

Some conversations must remain confidential to protect the City’s legal standing.

Personnel Matters Arise

If individuals are identified in the audit, those discussions may require privacy.

What Should NOT Happen

This is where accountability comes in.

Executive session should NOT be used to:

  • Delay or avoid releasing audit findings

  • Keep the public in the dark

  • Bypass transparency
